APPROPRIATE (ALTERNATIVE) DISPUTE RESOLUTION
Appropriate Dispute Resolution (ADR) refers to any means of settling disputes. ADR typically includes early neutral evaluation, negotiation, conciliation, mediation, arbitration, and the court.
Arbitrators and mediators have an important role in resolving disputes. Mediators are individuals trained in negotiations, who bring opposing parties together and attempt to work out a settlement or agreement that both parties accept or reject. Mediators act as neutrals to reconcile the parties differences before proceeding to arbitration or litigation. Arbitrators act as neutral third parties to hear the evidence and decide the case.
In today's world, it is inevitable that disputes will arise. Establishing resolution guidelines before a dispute occurs can help maintain relationships as well as prevent and minimize the impact of disputes if or when they occur. And when disputes arise, ADR methods, such as arbitration, mediation, and settlement procedures can deliver effective results that can satisfy the parties involved.
